1. Acceptance of Terms

By accessing or using the services provided by Hamilton Sales & Rentals Inc. ("we," "our," or "us"), including our website and container sales and rentals services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

Hamilton Sales & Rentals Inc. provides shipping container sales, rentals, and related services to residential and commercial customers. Our services include but are not limited to:

• Sale of new and used shipping containers
• Rental of shipping containers
• Container delivery and pickup
• Custom container modifications
• Consultation services for container solutions

3. Pricing and Payment

All prices listed on our website or provided in quotes are in Canadian dollars and do not include applicable taxes unless otherwise stated. Prices for container sales, rentals, and services are subject to change without notice. Payment terms are as follows:

• For container purchases: Full payment is required before delivery unless otherwise agreed in writing.
• For container rentals: A deposit and first month's rent are required before delivery. Monthly rental fees are due on the anniversary date of the delivery.
• For custom modifications: A 50% deposit is required before work begins, with the balance due upon completion.

4. Delivery and Pickup

Delivery and pickup services are available within our service area for an additional fee. The customer is responsible for ensuring adequate access to the delivery location, obtaining any necessary permits, and confirming that the site is suitable for container placement.

5. Rental Terms

Container rentals are subject to the following conditions:

• Minimum rental period is one month unless otherwise specified.
• Customer is responsible for the container during the rental period and must return it in the same condition, normal wear and tear excepted.
• Damage beyond normal wear and tear will result in additional charges.
• No modifications to rental containers are permitted without prior written approval.

6. Warranty and Liability

For container sales, we warrant that the container will be in the condition described at the time of sale. This warranty is valid for 30 days from the date of delivery. We make no other warranties, express or implied, regarding the containers or services.

Our liability is limited to the value of the products or services purchased. We are not liable for any indirect, special, incidental, or consequential damages.

7. Termination

We reserve the right to terminate or suspend services to any customer who violates these Terms of Service, with or without notice.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Your continued use of our services following any changes constitutes your acceptance of the new terms.
